Rules for buying and selling goods in the online shop morsobaltic.com
- General provisions
1.1. These Terms and Conditions of Sale and Purchase of Goods (hereinafter referred to as the “Terms and Conditions”), once accepted by the Buyer (by familiarising himself with the Terms and Conditions and by ticking the box next to the statement “I have read and accept the Senatorsandco.com Terms and Conditions”), are a legal document binding on the parties, which establishes the rights and obligations of the Buyer and the Seller, the conditions of purchase of the goods and the conditions of payment for the goods, the procedure for delivery and return of the goods, the liability of the parties and other provisions relating to the purchase and sale of goods in the morsobaltic.com online shop.
1.2. The Seller reserves the right to change, amend or supplement the Terms and Conditions at any time, taking into account the statutory requirements. The registered Buyer will be informed of any changes, corrections or additions at the time of logging in to Senatorsandco.com and will be required to re-accept the modified Terms and Conditions in order to shop in this online shop.
1.3. Senatorsandco.com is sold in the Baltic States and Poland.
1.4. You have the right to:
1.4.1. natural persons with legal capacity, i.e. persons who have reached the age of majority and whose legal capacity has not been restricted by a court;
1.4.2. minors aged between 14 and 18, with the consent of their parents or guardians, unless they are independent in the use of their income;
1.4.3. legal persons;
1.4.4. authorised representatives of all the above.
1.5. By accepting the Terms and Conditions, the Buyer confirms that, in accordance with 1.4. under clause 4, he/she is entitled to purchase goods from the morsobaltic.com online shop.
1.6. By accepting the Terms and Conditions, the Buyer confirms that he/she agrees that the instructions for the item(s) he/she has ordered in the Lithuanian language may, at the Seller’s discretion and subject to technical feasibility, be provided only in accordance with the provisions of the Terms and Conditions 2.2. in accordance with the procedure set out in Clause 4.1 to the e-mail address provided by the Buyer, by sending the Buyer an active link to this information at the time of preparation of the ordered item(s).
- Protection of personal data
2.1. There are two ways for the Buyer to order goods in the Senatorsandco.com online shop:
2.1.1. by registering on this website with your username and password;
2.1.2. without registering on this website.
2.2. When ordering goods, the Buyer shall both 2.1.1. both 2.1.2. In the ways provided for in the points of the Rules, in the relevant information fields provided by the Seller , he/she shall indicate his/her personal data necessary for the proper execution of the order: name, surname, delivery address, telephone number and e-mail address, and he/she may also indicate his/her gender and age.
2.3. By accepting these Terms and Conditions, the Buyer agrees that 2.2. his/her personal data referred to in point 1.1 shall be processed for the purposes of selling goods and services in the Senatorsandco.com e-shop, for the purposes of analysis of the Seller’s activity and for the purposes of direct marketing, and agrees that his/her personal data – his/her name, surname, address for delivery of the goods, telephone number and e-mail address – shall be disclosed to the Seller’s partners (data processors) providing delivery of the goods and other services relating to the proper execution of the Buyer’s order.
2.4. By consenting to the processing of his/her personal data for the purpose of the sale of goods and services in the Seller’s online shop, the Buyer also consents to the sending of information messages to the e-mail address and telephone number provided by him/her, which are necessary for the fulfilment of the order of goods.
2.5. If the customer does not wish to have his/her e-mail address processed for direct marketing purposes, he/she must go to the “My data” section of Senatorsandco.com, uncheck the box next to the statement “News e-mail”. email” and click “Update”. A Buyer who does not wish to have his/her telephone number processed for the purpose of direct marketing must inform the Seller of the fact in accordance with 2.1.1. in accordance with the procedure set out in point 5.1.
2.6. The Seller confirms that the personal data provided by the Buyer will be processed only for the purposes of selling goods and services in the Senatorsandco.com online store, analysis of the Seller’s activities and direct marketing (unless the Buyer notifies in accordance with the procedure referred to in point 2.5 of the Terms and Conditions that he/she does not want his/her personal data to be processed for the purposes of direct marketing). The Seller undertakes not to disclose the Buyer’s personal data to third parties, except for the Seller’s partners providing delivery or other services related to the proper execution of the Buyer’s order. In all other cases, the Buyer’s personal data may be disclosed to third parties only in accordance with the procedure provided for by the laws of the Republic of Lithuania.
2.7. As a data subject, the customer has the following rights:
2.7.1. receive information from the Seller about the processing of his/her personal data, i.e. to have access to his/her personal data and how they are processed, to receive information from which sources and what personal data have been collected, for what purpose they are processed, to which recipients they are provided and have been provided for at least the last 1 (one) year;
2.7.2. to request the rectification or destruction of his/her personal data, or to suspend, with the exception of storage, the processing of his/her personal data, where the data are processed in breach of the provisions of the Law on the Legal Protection of Personal Data and of other laws;
2.7.3. object to the processing of his/her personal data.
2.8. In accordance with Regulation 9.3.3. and 9.4.3. clauses, the Buyer’s identity document and the Buyer’s data contained therein submitted to the Seller’s or Lithuanian Post’s employee shall be used only for the purpose of proper identification of the Buyer’s identity.
2.9. A Customer who wishes to order services from partners offered by the Seller’s online shop may do so by consenting to the transfer of his/her personal data, as explicitly stated, to the relevant partner (data recipient) for the purpose of providing the services ordered.
2.10. In order to provide the Buyer with the full Senatorsandco.com services, the Seller records information on the Buyer’s computer (device) – cookies. The Seller uses the recorded information to identify the Buyer as a previous visitor to the Senatorsandco.com online store, to store information about the purchases placed in the Buyer’s shopping cart, and to collect statistics on the website’s attendance. The Buyer has the possibility to view the information (cookies) recorded by the Seller and to delete some or all of the cookies recorded. The Customer also has the right to object to the storage and use of information (cookies) on his/her computer (device), but in this case certain functions of Senatorsandco.com may not be available to him/her. By accepting the Terms and Conditions, the Buyer agrees to the recording of information on his/her computer/device. The Buyer may revoke this consent at any time by changing the settings of his/her web browser or by contacting the Seller at the contacts indicated in the Senatorsandco.com online shop.
2.11. Any request or instruction relating to the processing of personal data must be submitted by the Buyer to the Seller in writing in one of the following ways: by delivering such request or instruction to the Seller directly at the address Trakų g. 14, Vilnius, by sending such a request or instruction by post to the address specified in this paragraph of the Rules or by e-mail to info@senatorsandco.lt from the address specified in paragraph 2.2. the email address specified in point 4.1. The Seller, upon receipt of such a request or instruction from the Buyer, shall provide the Buyer with a written response within 30 (thirty) calendar days at the latest.
2.12. If the Buyer does not agree to the provisions of the Personal Data Protection as set out in this section of the Terms and Conditions, the Buyer shall lose the right to use the services provided by the morsobaltic.com online shop.
- The moment of conclusion of the sale and purchase agreement
3.1. The contract between the Buyer and the Seller shall be deemed to be concluded from the moment the Buyer, after having selected the product(s) to be purchased and having created a shopping cart, clicks on the “Checkout” link.
3.2. Each contract of sale concluded between the Buyer and the Seller shall be registered and stored in the Senatorsandco.com online shop database.
- Buyer’s rights
4.1. The Buyer shall have the right to purchase goods in the Senatorsandco.com online shop in accordance with the procedures set out in these Terms and Conditions and in the other information sections of the Seller’s online shop.
4.2. The Buyer has the right to withdraw from the contract of sale and purchase of goods concluded with Senatorsandco.com online store by notifying the Seller in writing (by e-mail, indicating the product to be returned and its order number) no later than 7 (seven) working days from the date of delivery/collection of the item, except in cases where the contract is concluded for:
4.3. Rule 4.2. The Buyer’s right provided for in point (1) shall be exercised in accordance with the provisions of the Regulation of the Minister of the Economy of 2001. 17 August the “Rules governing the sale of goods and the provision of services by means of communication”, approved by Order No 258.
4.4. The Buyer may exercise the right provided for in Clause 4.2 only if the goods have not been damaged or substantially altered in appearance and have not been used.
4.5. In the event that the Buyer purchases a set of goods in Senatorsandco.com online store and in accordance with the provisions of the Rules 4.2. the right provided for in Clause 4.1, he/she wishes to withdraw from the contract of sale in respect of the particular item(s), he/she must return the complete set of goods to the Seller, i.e. the Buyer may in such a case exercise the right provided for in Clause 4.2 of the Conditions. the right provided for in point (a) only in respect of all the goods in the set. In the event that any of the items in the set does not meet the requirements set out in Clause 11.4 of the Rules, the Seller shall have the right to refuse to accept the returned set of goods.
- Obligations of the buyer
5.1. The Buyer shall pay for and accept the Goods in accordance with these Conditions.
5.2. Once registered, the Buyer undertakes not to disclose his/her login details to third parties. If the Buyer loses his/her login details, he/she must immediately inform the Seller using the means of contact specified in the “Contact” section.
5.3. If the data provided by the registered Buyer in the registration form changes, the registered Buyer must update it immediately.
5.4. By using the Senatorsandco.com online shop, the Buyer undertakes to comply with these Terms and Conditions, the other terms and conditions expressly stated in the online shop, and not to violate the legislation of the Republic of Lithuania.
- Seller’s rights
6.1. The Seller shall have the right, at its sole discretion, to determine the minimum basket size, i.e. the minimum amount at which the Buyer’s order will be filled. The amount is visible when you view the shopping basket.
6.2. If the Buyer attempts to undermine the stability and security of the online shop or violates his/her obligations, the Seller shall have the right to restrict or suspend the Buyer’s access to the online shop or, in exceptional cases, to cancel the Buyer’s registration, immediately and without warning.
6.3. In important circumstances, the Seller may temporarily or permanently discontinue the operation of the Online Shop without prior notice to the Buyer.
6.4. The Seller shall have the right to cancel the Buyer’s order without prior notice to the Buyer if the Buyer, having chosen the option in 8.2.1. with 8.2.2. the methods of payment provided for in clauses 3.1.1, fails to pay for the goods within 3 (three) working days.
6.5. Where the Buyer chooses to comply with 8.2.4. In the event of any uncertainty regarding the information provided in the order, the Seller shall contact the Buyer by telephone number specified in the order. In such case, the delivery period shall commence from the date of contact with the Buyer. The Seller shall have the right to cancel the Buyer’s order without prior notice to the Buyer if the Seller fails to contact the Buyer within 3 (three) working days.
- Seller’s obligations
7.1. The Seller undertakes to enable the Buyer to use the services provided by the Senatorsandco.com online shop, subject to the terms and conditions set out in these Terms and Conditions and in the Online Shop.
7.2. The Seller undertakes to respect the Buyer’s right to privacy of his/her personal information, i.e. to process the personal data specified by the Buyer only in accordance with the procedure set out in Section 2 of the Rules and the legislation of the Republic of Lithuania.
7.3. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer in accordance with the conditions set out in Section 9 of the Conditions.
7.4. If the Seller is unable to deliver the goods ordered to the Buyer due to important circumstances, the Seller undertakes to offer an analogous or, as far as possible, similar product. If the Buyer refuses to accept an analogous or similar product, the Seller undertakes to refund the Buyer the money paid within 3 (three) working days, if prepayment has been made.
7.5. If the Buyer has exercised the provisions of Regulation 4.2. the right provided for in point 4.4. the condition set out in clause 1, the Seller undertakes to reimburse the Buyer within ten (10) working days from the date of receipt of the returned goods.
- Prices, payment procedures and terms
8.2. The buyer pays for the goods in one of the following ways:
8.2.1. When completing the order, select “Payment by Mokejimai.lt” at the “payment method” step. Choose the bank you want to pay with and you will be redirected to the Payment.lt page with detailed information about your purchase. Once your order has been confirmed, you will need to log in to Online Banking and pay for your order. Once your order has been paid, you will be returned to Senatorsandco.com.
8.2.3. Payment in cash on delivery/collection – the Buyer shall pay for the goods on delivery/collection (handover – acceptance).
8.3. In settlement of 8.2.1, 8.2.2. and 8.2.3. the methods of payment provided for in Clauses 1 and 2, the Buyer undertakes to pay immediately. In these cases, taking into account the provisions of Regulation 6.4. the Seller’s right under Clause 4.1, only upon receipt of payment for the Goods shall the parcel of Goods begin to be formed and the time limit for delivery of the Goods begin to run.
8.4. By accepting the Terms and Conditions, the Buyer agrees that the purchase documents, i.e. the VAT invoices, which are also the guarantee vouchers for the goods, shall be provided to the Buyer electronically at the e-mail address indicated in the Buyer’s registration form. The Seller shall also place the VAT invoices of the goods purchased by the Buyer on Senatorsandco.com in the “My Senatorsandco.com” section. VAT invoices in the above form shall be submitted to the Buyer no later than the time of delivery of the goods to him. Once the customer has placed an order, he/she can see and print the order sheet – the pre-paid invoice – under “My Senatorsandco.com”. The invoices shall specify the goods selected, the quantity, the discounts to be granted, the final price of the goods, including all taxes, delivery charges, the administration fee referred to in 8.6 of the Rules. and any other information required by the legislation governing accounting.
8.5. The Buyer and the Seller agree that after the Buyer has placed an order for the goods and the Seller has confirmed it, the price of the goods may change, taking into account objective indicators affecting the price of the goods, such as an increase in the cost of the goods, a technical error in the information systems, or additional costs related to the sale of the goods to the Buyer (Art.6.313, Art.) If the Buyer does not agree to purchase the Goods at the new price, either Party shall have the right to terminate the contract of sale of the Goods upon notice to the other Party. The Parties agree that no damages shall be payable in connection with the termination of the Purchase and Sale Agreement in accordance with this Clause.
- Delivery of goods
9.1. When ordering the goods, the Buyer may choose the method of delivery of the goods, i.e. to use the Seller’s delivery service or to collect the goods from one of the Lithuanian Post Offices or the Seller’s collection point.
9.2. Delivery of goods to the Buyer:
9.2.1. The Buyer undertakes to specify the exact place of delivery of the goods by selecting the delivery service at the time of ordering.
9.2.2. The Buyer undertakes to accept the goods himself. In the event that the Buyer is unable to take delivery of the goods himself and the goods have been delivered to the address indicated and on the basis of other data provided by the Buyer, the Buyer shall not be entitled to make any claim against the Seller in respect of the delivery of the goods to the wrong entity.
9.2.3. Goods shall be delivered by the Seller or its authorised representative.
9.2.4. The delivery/transportation fee is calculated according to the place of delivery and the weight of the goods, and whether the Buyer wishes to use a delivery service:
9.4.1. The Buyer may collect the goods free of charge from the Seller’s collection point located at Trakų g. 14, Vilnius.
9.4. Collection of goods from the Seller’s collection points:
9.4.2. Ordered goods must be collected no later than within 3 (three) working days from the moment of receipt of the Seller’s confirmation that the order is ready.
9.4.3. Goods can only be collected by the person who placed the order or the person specified at the time the order was placed. You must have a valid ID (ID card, passport or new driving licence) with you when you collect your goods and present it to the Seller’s employee.
9.5. The Seller shall deliver the Goods to the Buyer in accordance with the terms specified in the descriptions of the Goods. These time limits are provisional and do not apply in cases where the Seller does not have the goods in stock and the Buyer is informed of a shortage of the goods ordered. The Buyer also agrees that in exceptional cases the delivery of the goods may be delayed due to unforeseen circumstances beyond the control of the Seller. In this case, the Seller undertakes to contact the Buyer immediately to agree on the terms of delivery.
9.6. In all cases, the Seller shall be exempt from liability for breach of the time limits for delivery of the goods if the goods are not delivered to the Buyer or are not delivered on time due to the Buyer’s fault or due to circumstances beyond the Buyer’s control.
9.7. At the time of delivery of the Goods to the Buyer, the Buyer shall inspect the condition of the consignment and the Good(s) together with the Seller or its authorised representative and sign the document of delivery and acceptance. Once the Buyer has signed the handover acceptance document, the handover shall be deemed to have been made in good condition, and there shall be no damage to the goods attributable to defects other than manufacturing defects and no inconsistencies in the composition of the product(s) (such as can be detected by an external inspection of the goods). If the Buyer notices that the packaging of the delivered consignment is damaged (crumpled, wet or otherwise externally damaged), that the item(s) are damaged and/or that the item(s) are not in the right condition, the Buyer shall note this in the handing-over/acceptance document of the consignment, and shall draw up a free-form certificate of the damage/deficiencies to the consignment and/or the item(s), in the presence of the Seller or his representative. If the Buyer fails to do so, the Seller shall be exempt from liability to the Buyer in respect of any damage to the goods, provided that such damage is not due to a manufacturing defect, and in respect of any non-conformity of the goods, provided that such non-conformity can be ascertained by an external inspection of the goods.

- Guarantee of the quality of the goods and their shelf life
10.1. The characteristics of each item sold by Senatorsandco.com are generally indicated in the description of each item.
10.2. The Seller shall not be liable for the fact that the colour, shape or other parameters of the goods in the online shop may not correspond to the actual size, shape and colour of the goods due to the characteristics of the display used by the Buyer.
10.3. For certain types of goods, the seller offers a guarantee of the quality of the goods for a certain period of time, the specific term and other conditions of which are set out in the descriptions of such goods.
10.4. Where legislation prescribes a certain shelf life for particular goods, the Seller undertakes to sell such goods to the Buyer in such a way that the Buyer has a realistic opportunity to use such goods before the expiry of the shelf life.
- Returning and exchanging goods
11.1. Any defects in the goods sold are rectified, and faulty goods are replaced or returned in accordance with the provisions of the Minister of the Economy 2001. 29 June the rules on the return and exchange of items, approved by Order 217 “On the Approval of the Rules on the Return and Exchange of Items”.
11.2. To return the product(s) 11.1. In the cases referred to in the Regulations, the Buyer shall complete a returns document, which shall be attached to the goods ordered by the Buyer, and submit it together with the returned item(s).
11.3. 11.1. The Buyer may exercise the right provided for in the Clause within 7 (seven) working days from the date of delivery of the goods to him by informing the Seller 4.2. In accordance with the procedure set out in point 3 of the Rules.
11.4. The following conditions must be observed when returning goods to the buyer:
11.4.1. the returned product must be in its original packaging in good condition (this does not apply if you are returning a faulty product);
11.4.2. the goods must be in good condition and undamaged by the Buyer;
11.4.3. the product must be unused and in good condition (no damaged labels, no torn protective film, etc.) (this does not apply if you are returning a low-quality product);
11.4.4. the returned goods must be in the same condition as when received by the Buyer;
11.4.5. When returning the product, you must present the document of purchase, the guarantee voucher (if issued) and the completed return document referred to in point 11.2. of the Regulations.
11.5. The Seller shall have the right not to accept the Buyer’s returns if the Buyer does not comply with the return procedure set out in this Article.
11.6. The Buyer may deliver the returned goods himself to the address Trakų g. 14, Vilnius on weekdays from 8.00 to 17.00 or send it by the courier of your choice. In the event of a return in accordance with 4.2. the right provided for in clause 2, the Buyer shall bear the costs of returning the goods. In the event of a return of the wrong goods and/or goods of poor quality, the Seller undertakes to take back such goods and to replace them with similar suitable goods. In the event that the Seller does not have similar goods, the Seller shall refund the money paid for the item(s) to the Buyer.
11.7. Returns and exchanges shall be carried out in accordance with the provisions of the Minister for Economic Affairs 2001. 29 June the “Rules on the Return and Exchange of Items”, approved by Order No 217 and the “Rules on the Return and Exchange of Items”, approved by the Minister of Economy in 2001. 17 August the “Rules governing the sale of goods and the provision of services by means of communication”, approved by Order No 258.
- Responsibility
12.1. The Buyer is fully responsible for the correctness of the personal data he/she provides. If the Buyer fails to provide accurate personal data, the Seller shall not be liable for the consequences thereof and shall be entitled to claim direct damages from the Buyer.
12.2. The Buyer is responsible for the actions taken when using this online shop.
12.3. Once registered, the Buyer is responsible for the transmission of his/her login data to third parties. If the services provided by Senatorsandco.com are used by a third party who has logged into the online shop using the Customer’s login details, the Seller shall consider this person as the Customer.
12.4. The Seller shall be exempt from any liability where the loss is caused by the Buyer’s failure to read these Terms and Conditions, despite the Seller’s advice and obligations, when given the opportunity to do so.
12.5. If the Seller’s online shop contains links to the websites of other companies, institutions, organisations or persons, the Seller is not responsible for the information or activities contained therein and does not maintain, control or represent such companies and persons.
12.6. The Seller shall not be liable for the proper performance of the obligations between the Buyer and the Seller’s partners whose services the Buyer orders.
12.7. In the event of damage, the party at fault shall compensate the other party for direct damages.
- Marketing measures taken by the trader
13.1. The Seller may, at its sole discretion, initiate various promotions on the Senatorsandco.com online shop.
13.4. The Seller shall have the right to unilaterally, without prior notice, modify the terms and conditions of the promotions, as well as to cancel them, and to unilaterally, without prior notice, modify the terms and conditions of the use of the use of the payment for the goods as well as to cancel them. Any change or cancellation of the terms and conditions of promotions, the use of promotions in payment for goods shall be effective only prospectively, i.e. from the moment of their execution.
- Exchange of information
14.1. The Seller shall send all notices in accordance with Article 2.2. in accordance with the procedure set out in Clause 4.1 to the e-mail address provided by the Buyer.
14.2. The Buyer shall send all notifications and questions to the Seller’s online shop in the section “Contact” by the means of contact indicated.
- Final provisions
15.1. These Rules are drawn up in accordance with the legislation of the Republic of Lithuania.
15.2. Relationships arising under these rules are governed by the law of the Republic of Lithuania.
15.3. Any disagreements arising from the implementation of these rules shall be settled by negotiation. In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
